P & Z Meeting Minutes
May 7, 2018 7:00 P.M.
Members Present: Robert Wilson, Bob Blondo, Jack Bickler, Joe Gallant, Jarad Giddens, Loren Winter, Steve Huff, David Young. Members Absent: Bud Jones.
The minutes from April 2 2018 were approved with a motion from Joe Gallant and a second from Jack Bickler. All voted aye.
The agenda was approved with a motion from Bob Blondo and a second from Joe Gallant. All voted aye.
18-05-01 Preliminary Plat Amendment – McCroskey Plaza
Staff Report:Travis Cossey presented the staff report for the Preliminary Plat Amendment for McCroskey Plaza. Mr. Cossey stated that the original preliminary plat was approved in 2005 with a condition that there would be no access to Northview because of traffic concerns. Lot 1 of McCroskey Plaza is currently under contract with Kum & Go who is requesting a modification of the site to allow for full movement access onto Northview Dr.
The applicant has submitted a site plan requesting full movement access onto Northview located 210 ft from the Hwy 160 intersection. A Traffic Impact Study prepared by Peters and Associates Engineers was submitted providing support for the proposed full movement access.
Staff contacted OTO and CJW Transportation requesting a review and recommendation of the information provided by the applicant. Mrs. Sara Fields, Executive Director of OTO concluded that the study failed to address the concerns arising from future growth or the conflicts resulting from a new driveway with the current issues from the commercial property just north of Northview Rd. Mr. Dane Seiler, President of CJW Transportation provided that given the existing conditions found north of the site that the proposed drive was located too close to the US 160 intersection. His recommendation was to move the access point to the east locating the drive from the center of McCroskey to the center of the proposed entrance.
Staff cannot support the application as submitted, however understanding that access onto Northview is vital to the success of the proposed business, staff is supportive of a right in right out access only onto Northview.
Robert Wilson opened the public hearing to anyone who would like to speak on the request.
Austin Herschend, Big Whiskeys Bar & Grill, stated that he had originally bought this property in conjunction with the Ruby Tuesdays in Republic. He feels that opening this location as a Big Whiskeys would be counterproductive to his business locations in Springfield and Republic. Would like for the city to allow for full access from Northview so that Kum & Go will go ahead with the purchase of the property.
Robert Fiebig, Site Development Manager for Kum & Go, handed out comparison maps to show the scenario that they want, and the scenario the City wants. Mr. Fiebig stated that any delivery trucks would use the McCroskey entrance to keep big trucks from the Northview entrance. He feels that the concerns for traffic issues is unfounded and that in order for them to be able to build this building they need full access. Steve Huff asked Mr. Fiebig if the original site and building plan could be redesigned to accommodate the right in right out proposed by the City. Mr. Fiebig said no. Mr. Fiebig stated that he felt with the traffic study showing 2500 cars a day that it wasn’t a conflict to have the access where they are requesting.
Brad Thessing, Kum & Go, stated that he felt they were in line with the future growth of that area.
Loren Winter asked if the Commission was tasked with just allowing access to Northview. Mr. Cossey stated that yes that was what the vote would be on, and it would also allow to add any restrictions to that access if the Commission chose to do so.
Zack Marsden, 912 Wesley Dr, lives in this area. Mr. Marsden stated that as someone who drives this area daily and has to make turns onto Northview, he feels that it is dangerous enough without having a full access entrance/exit.
Robert Wilson stated that he doesn’t support any type of entrance onto Northview. Loren Winter stated that the Kum & Go on Plainview in Springfield has a full access entrance/exit a lot closer to the intersection than this location and there doesn’t seem to be any problems. He is on the fence at this point but can see the necessity of full access onto Northview. Mr. Cossey said that you couldn’t really compare it to the Plainview location because each site has unique conditions, the commercial lot across the street on Northview is a wide-open lot that allows cars to enter and exit at any point along the road.
Loren Winter made a motion to approve access onto Northview Rd with a right in and right out access only with right turn lane into the property with a second by Steve Huff. 7 ayes, 1 nay. Motion passed.
18-05-02 Article IV – Telecommunications Sitings of Wireless Communications Towers.
Mr. Travis Cossey presented the Staff Report for the request. Mr. Cossey stated that with the recent passing of new laws governing locations of Telecommunication Towers that the City of Nixa needed to update our existing regulations.
Mr. Wilson asked if there was anyone here to speak about this issue. No one approached the Commission.
Joe Gallant made a motion to approve the amendment as stated with a second by Bob Blondo. All voted aye.
